In a recent measure, CODAR Executive Declaratory Act No. 14 established a new revenue code. Therefore, this code will be used to collect Income Tax Withheld at Source (IRRF) levied on net prizes obtained from bets on the Fixed Quota Betting Lottery.

What does this mean for online betting in Brazil?

This change has a direct impact on the sports betting and online gaming sector in Brazil. Now, net prizes obtained from bets will be subject to IRRF. This specifically refers to the Fixed Odds Betting Lottery, as mentioned in art. 31 of Law No. 14,790.

The Federal Revenue Collection Document (Darf) now uses the new revenue code, 6313. This will facilitate the collection of IRRF on net prizes obtained in bets.

Federal Revenue Declaratory Act:

THE GENERAL COORDINATOR OF COLLECTION AND CREDIT LAW, in the use of the attribution conferred on him by item II of art. 358 of the Internal Regulations of the Special Secretariat of the Federal Revenue of Brazil, approved by Ordinance ME nº 284, of July 27, 2020, and in view of the provisions of art. 31 of Law No. 14,790, of December 29, 2023, states:

Art. 1 The revenue code 6313 – IRRF – Net Prizes Obtained in Bets on the Fixed Quota Betting Lottery is hereby established, to be used in the Federal Revenue Collection Document (Darf) in the collection of Income Tax Withheld at Source ( IRRF) levied on net prizes obtained from bets on the Fixed Quota Betting Lottery referred to in art. 31 of Law No. 14,790, of December 29, 2023.

Art. 2 This Executive Declaratory Act comes into force on the date of its publication in the Official Gazette of the Union.
