The Communication Committee of the Chamber of Deputies approved a proposal that prohibits influencers from advertising unregulated gambling online.

According to the text, these professionals are responsible for ensuring that their content does not disclose these activities in videos, stories and other forms of digital communication.

Failure to comply with the rules subjects the influencer to penalties of warning or suspension of activity for up to six months, which can be extended.

For the social media provider, the punishment will be a fine of up to 2% of the company’s revenue.

Processing

The proposal was approved in the form of the substitute presented by the rapporteur, deputy Fred Linhares (Republicanos-DF), to PL 3915/23, by deputy Ricardo Ayres (Republicanos-TO), and three annexes.

According to Agência Câmara de Notícias, Ayres stated that the objective is to prohibit “irresponsible disclosure of betting companies by influencers”.

Furthermore, the rapporteur considered the measure to be “paramountly relevant” due to “the significant impact that such public figures have on their followers, influencing behavior and decisions”.

However, it is worth highlighting the proposal that will still be analyzed in the Finance and Taxation, Constitution and Justice and Citizenship (CCJ) committees.

Subsequently, the bill will be considered by the Plenary of the Chamber.

Other points of the proposal that aims to regulate the relationship between influencers and games

The substitute presented by Linhares also prohibits the advertising of regulated games aimed at minors.

The text also provides:

  • Advertising content published by influencers must inform the commercial nature of the publication;
  • The material must include information that allows the person responsible for paying for bets to be identified;
  • Influencers must inform about the negative consequences associated with betting, such as financial risks and psychological disorders;
  • The relationship between the digital influencer and his contractor must be governed by a written contract, detailing the type of advertising work;
  • The marketing of advertising by a foreign provider will be carried out by its representative in Brazil.

Awareness

Therefore, the text also determines that the Federal Government encourages awareness campaigns about the risks of betting, in collaboration with educational institutions and health professionals.
