Published in last Monday’s edition of Gazeta Municipal, 3, Municipal Decree 9.697, of June 30, 2023, which provides for authorization for the accreditation of Lottery Agents in Cuiabá, development and creation of tools aimed at the most efficient meeting of objectives the creation of the Cuiabana Lottery.
In view of the regulations, it will be possible to register these workers to sell in their own system, through lottery terminals and kiosks, on a precarious basis, Instant Lottery tickets (the player buys the ticket, scrapes the covered fields, revealing the combinations of engraved numbers or symbols, and you know at the time if you won) and Prognosis (is the indication, by the bettor, of a draw or victory of one of the competitors, in the regular time of the match) in different points of the capital.
They are responsible for carrying out activities such as customer service, payment and receipt of bank slips and bills such as water, energy and telephone, return of change, sale of products offered by lottery companies such as tickets, meat and sweepstakes, in addition to making withdrawals, deposits, among others. Lottery Agents are fully responsible for the distribution and marketing of tickets at their Points of Sale, distributed by them for resale purposes to their final consumers.
The Lottery Agent will be responsible for all costs related to the logistical, technological and personnel infrastructure necessary for the sale and validation of tickets, including all tax, labor, social security charges and indemnities of any kind claimed by its employees and / or harmed third parties.
The lottery terminals, owned or legally used by third parties, must have internationally accepted certification in their hardware and software and a Random Number Generator Certificate, issued by a certifying entity such as GLI – Gaming Labs International, BMM Testlabs, Eclipse Compliance Testing or similar. Those involved in each series of Instant Lottery and Prognosis Lottery distributed through lottery terminals or kiosks must previously guarantee, through their own guarantee, the amounts offered as prizes, regardless of the sale of tickets, as provided for in the Economic Qualification.
All bets made by the consumer must be printed by lottery kiosks using flyers, containing the LOTEC logo, date, time, ticket number, extraction number, face value, selection of the set of numbers chosen and a code steering wheel validation bar icon. Lottery kiosks must have a banknote acceptor, thermal printer and video monitor.
The winning tickets will be paid upon proper validation in the Lottery Agent system, which will be connected to the Lottery of the Municipality of Cuiabá for visualization and control, through a receipt containing the date, extraction number and validation bar code. Prize plans and game projects will be defined by the Lottery Agent and completely random. The Prognosis Contest consists of the indication, by the consumer, of a set of predictions about whole numbers, with subsequent drawing of numbers. This system must be able to process at least 15 (fifteen) extractions per hour.
The Lottery Agent accredited by the Municipal Treasury Department is obliged to pay the prize to the final consumer up to the current individual income tax exemption amount provided for in the Progressive Income Tax Table, per winning ticket. As for the winners of prizes with values above the first range of the monthly incidence table of the Individual Income Tax, they must be presented to the Municipal Treasury Department, bearing their identity card, CPF, proof of residence and proof of payment of the Income Tax due, for the purposes of the registration procedure.
In the foreseen prizes, the contemplated bettor will receive the net prize already with the due tax withheld and his receipt of the Income Tax guide. The possibility of presenting a letter of guarantee to guarantee the prizes made available is instituted, which must fully cover the value of the prizes made available.
The winning tickets will be paid upon proper validation in the Lottery Agent system, which will be connected to the Lottery of the Municipality of Cuiabá for visualization and control, through a receipt containing the date, extraction number and validation bar code. Subject to communication to the Financial Activities Control Council – COAF, the payment of premiums covered by Law n. 9,613/98, without prejudice to the competence of other bodies and entities.
About the Cuiabana Lottery
Mayor Emanuel Pinheiro, sanctioned in 2022, Law 6.872, which regulates the creation of the Cuiabana Lottery, in accordance with the guidelines provided for in federal regulation nº 13.756/2018. The project was approved by the Chamber of Councilors and received 16 favorable votes.
The modality of games and betting – category prognostic contests, has the potential to encourage municipal collection, in view of the negative financial impacts caused to public coffers due to the Covid-19 pandemic.
