The weekly Podcast, which airs on Mondays, and is led by Amanda Kestelman, Ana Thais Matos and Bárbara Coelho, addressed the theme “Sports Betting”.

Reporter Fred Justo joined the trio to discuss the issue in issue 56 of the Triple Round.

The podcast, by GloboEsporte, evaluated the context called “gray zone”, involving from bookmakers to the risk of manipulating results due to the delay in creating specific rules for this sector in Brazil.

Regulatory process for sports betting in the country

“The idea of ​​this project, which was approved by the government of then President Michel Temer, is to promote tourism. They want to create casinos in the Northeast, to create bookmakers. Do something similar to what happens in the United States, in Las Vegas, ”said reporter Fred Justo.

Since the passage of the law, bookmakers are increasingly present on the national scene and it is estimated that the global market will move approximately 1.8 trillion euros annually.

In the country, these platforms are currently in a gray situation, as defined by lawyer Luciano Andrade Pinheiro, partner at Corrêa da Veiga Advogados;

“These sites that operate in Brazil are not hosted here, but abroad. We understand that whoever makes this sports bet in Brazil is not committing any type of illegal act, no criminal offense ”, he said.

Initially, Caixa Econômica Federal does not intend to have a relationship with this area, since the law establishes a competition system. Therefore, after completing the regulation, private companies will be required to comply with all measures determined by the Federal Government.

Result manipulation hazard

At the beginning of the year, a system of manipulation of results in soccer competitions in Rio de Janeiro was denounced by Justo in a report on Esporte Espetacular, on TV Globo. At the moment, the law in force in Brazil does not stipulate criminal liability for legal entities.

In general, the authorities end up fining the managers, players or referees who were caught in the irregularities. Recalling that the rules were even modified after the discovery of the Whistle Mafia in 2005.

Therefore, teams tend to take sanctions based on the code prepared by FIFA, since the Brazilian Code of Sports Justice (CBJD) does not directly address the issue.

“We have a law since the Mafia of the Whistle with Edilson Pereira de Carvalho. In 2010, three articles dealing with the manipulation of results were included in the Fan Statute “, explained lawyer Tiago Horta Barbosa.

Barbosa added: “Until today, no one has been criminally punished in Brazil for this. This creates an idea of ​​impunity. If that continues, all fraud detection work will collapse. ”
