
The Senate decided to prohibit athletes, artists and influencers from participating in advertising campaigns for sportsbooks in Brazil. The text now goes to the Chamber of Deputies for analysis.
The proposal, approved by the house’s Sports Committee, included an urgent request to put the topic on the voting agenda this Wednesday (28). The report by Senator Carlos Portinho (PL-RJ) prohibits athletes, artists, communicators, influencers, authorities or any individual from participating in advertising and publicity for sportsbooks.
The only exception in the text is regarding the participation of former athletes. Professionals who ended their sports careers at least five years ago can participate in advertising campaigns for sportsbooks.
Advertising of sportsbooks with restricted opening hours
Portinho’s report also prohibits the disclosure of sports bets that suggest personal success. Furthermore, the text prevents the campaign from indicating that the modality represents an alternative to employment, a solution to financial problems, a source of additional income, a form of financial investment, a guarantee and a promise of financial return.
Advertising on TV and radio will have time restrictions. Broadcast on open television, subscription television, streaming services, social networks and other internet providers have restricted hours, only between 7:30 pm and midnight. On the radio, between 9am and 11am and between 5pm and 7:30pm.
Pieces aimed at children and young people are also prohibited. According to the text, animations, drawings, mascots, including those produced by artificial intelligence that stimulate children and adolescents are prohibited.
Gambling companies that sponsor clubs cannot include logos on the uniforms of underage athletes. The inclusion of brands is permitted as long as the player is not under 18 years of age.
In fact, the regulation, which came into effect in January of this year, already prohibited this type of advertising. In addition, betting on youth competitions, such as the famous São Paulo Junior Football Cup, is prohibited.
According to the text, the sale of clothing from sports clubs and teams sponsored by sportsbooks to children and teenagers is prohibited.
Another determination of the project is that betting houses must publish warnings about the alleged harm caused by sports betting. Just like on cigarette packaging, companies will be required to display advertising discouraging gambling in a “clear and conspicuous” manner with the phrase “Gambling causes addiction and harm to you and your family.”
