Carla Vicente presents her new book 'Noção de Jogo'

Graduated in Law, with two postgraduate degrees in Administrative Law and one in European Union Law, Carla Vicente is a legal advisor to the Ombudsman in Portugal, with several works published in the area of ​​Administrative Law.

In the work ‘Noção de Jogo’, Carla analyzes the legal notion of Gambling, also known as Gambling, Gambling or Gambling, always bearing in mind the practical consequences of classifying an activity as Gambling.

Starting from a brief review of the historical evolution of the notion of Game in five legal systems (Belgium, Spain, France, Portugal and the United Kingdom), by comparing it with the current notion in each of them, we arrive at the conclusion that the notion of The game is less and less uniform, with luck becoming less and less relevant as a criterion for subjecting an activity to the Law of the Game.

On the other hand, equity elements – investment/premium – are increasingly decisive. More than censuring the attainment of easy fortune through luck, the Law of Gambling and the consequent notion of Gambling, increasingly neutral from an axiological point of view, tend to cover more activities, even those of expertise, with the ultimate aim of protecting the player and public order (eg associated gambling and criminality).

It seeks to explain the reasons for this evolution and understand the current limits of Gaming Law, which required the confrontation with activities of expertise, with sport and esports, passing through fantasy sports, the phenomenon of monetization of videogames and the tendency gamification of games of chance translated, namely, into the appearance of slot machines with elements of skill.

The definition of Game currently lives between two requirements: on the one hand, and due to its criminal relevance, it has to be sufficiently precise; on the other hand, technological evolution calls for a flexible definition that allows its application to new forms of Game.
