Lottopar joined as an interested party in a class action in the State Court of Rio de Janeiro against LOTERJ, the Rio de Janeiro lottery.
The state public company in Paraná seeks to preserve market stability and guarantee legal security for operators and bettors.
But although it is not the holder of the action, Lottopar highlights its commitment to complying with current legislation and respecting territoriality.
Why Lottopar joined the lawsuit
The Federal Supreme Court, recognizing the lottery as a public service, determined that its operation must comply with the territorial limits of each federative entity.
Before Law No. 14,790/2023, authorities limited the operation of the lottery to state and national territories, as necessary.
Below is Article 35-A of Law No. 14,790/2023:
Art. 35-A. The States and the Federal District are authorized to operate, within their territories, only the lottery modalities provided for in federal legislation.
§ 4º Lottery marketing and advertising by the States or the Federal District carried out in physical, electronic or virtual media will be restricted to people physically located within the limits of their districts or those domiciled within their territoriality.
Therefore, with the new law, the States and the Federal District are authorized to explore only the lottery modalities provided for in federal legislation.

LOTERJ, in turn, created a legal fiction of territoriality through a notice. In other words, it will allow bets made in any part of Brazil to be considered in the territory of the State of Rio de Janeiro.
However, Lottopar reaffirms that only bettors physically located in the territory of Paraná can place sports bets on sites authorized by Lottopar or on federally licensed betting sites.
Therefore, operators without a Lottopar license, federal license or license from other states, who wish to offer sports betting in Paraná, are acting illegally.
In this way, Lottopar reiterates its commitment to legality and respect for current regulations, ensuring a safe and regulated environment for bettors and operators.
