Procon-SP and OAB/SP launched the booklet “Consumer Rights in Gaming and Sports Betting in Brazil” this Thursday (18). The material aims to explain the rights and main rules of the sector. Furthermore, it teaches how to identify signs that gambling may be leading the bettor to emotional and financial insecurity, such as gambling addiction.
The booklet is available for free download on the OAB SP and Procon-SP websites. See it here. According to Federal Law No. 14.790/2023, all bettors are consumers. Therefore, all rights provided for in the Consumer Protection Code are guaranteed to those who bet.
Aiming to reach as many people as possible following the popularization of sports betting, the material offers information such as advertising rules, authorized payment methods, prize withdrawal deadlines, liability for service issues, and personal data protection (LGPD). Furthermore, it lists which defense agencies bettors can turn to.
According to Carina Minc, chief advisor at Procon-SP, the goal is to better inform people. “It’s essential that we better inform consumers. They need to know that they are gambling consumers, whose rights are protected by law.”
“And, because it’s a recent regulation, consumers aren’t used to this new reality. The guide was created from this need to empower gambling consumers,” he explained.
Booklet presents channels for reporting the illegal betting market
Consumers can also find addresses of protection and prevention agencies, information on the risks of gambling addiction, tips for preventing financial and emotional instability, and who to turn to in cases of gambling addiction in general.
Therefore, complaints regarding misleading advertising or failure to protect personal data can be filed on the Procon-SP platform. The platform also receives complaints about difficulties in withdrawing prizes, inadequate service, and damages suffered due to service failures.
In addition to reporting misleading information provided on the platform or at the betting terminal, which can be done online and in person at service points or at municipal Procons.
