The São José dos Campos (SP) City Council began analyzing the possible repeal of the law that authorized the creation of the Municipal Lottery in the city. The topic returned to debate after the presentation of Complementary Bill 6/2026, filed by councilor Lino Bispo (PL).
The proposal provides for the repeal of Complementary Law 694, sanctioned on September 23, 2025, responsible for establishing the public municipal lottery service.
The case draws attention because Lino Bispo himself supported the creation of the lottery during the vote on the project in the Chamber in 2025. Now, however, the parliamentarian defends the repeal of the legislation based on the understanding of the Federal Supreme Court (STF) on the exploitation of lottery services in the country.
According to the justification presented in the project, Federal Law No. 13,756/2018 expressly authorized the exploration of lotteries only by states and the Federal District. In this way, municipalities would not have legal authorization to operate in this segment.
Furthermore, the text argues that this legal understanding bars São José dos Campos from receiving municipal lottery proceeds.
How was the lottery voting in São José dos Campos
The creation of the Municipal Lottery was approved by the Chamber in 2025 by 16 votes in favor and five against. At the time, the project generated debates among councilors as it involved public fundraising and the exploitation of betting in the municipality.
Councilors Claudio Apolinário (PSD), Fabião Zagueiro (PSD), Gilson Campos (PRD), Juliana Fraga (PT), Lino Bispo (PL), Marcão da Academia (PSD), Marcelo Garcia (PRD), Milton Vieira Filho (Republicans), Rafael Pascucci (PSD), Renato Santiago (União), Roberto do Eleven (PSD), voted in favor. Rogério da Acasem (PP), Senna (PL), Sidney Campos (PSDB), Thomaz Henrique (PL) and Zé Luís (PSD).
On the other hand, councilors Amélia Naomi (PT), Carlos Abranches (Citizenship), Fernando Petiti (PSDB), Roberto Chagas (PL) and Sérgio Camargo (PL) voted against.
Currently, the project that proposes the repeal of the lottery is still being processed at the São José dos Campos City Council.
