SPA aims to regulate online gambling providers, but the sector will close 2025 without rules

Since January of this year, the regulation of the online betting market has been in effect. It includes rules for operators, game certification, technical standards, and definitions of how legalized platforms should operate in the country. However, there is still one point that needs further definition: the role of online gaming providers.

In this case, we are talking about the agents responsible for developing and distributing content to both authorized betting websites and platforms. These still operate without their own specific legislation.

Currently, these providers adhere to standards of reliability and certification, which oversee the technical functioning of the games, as well as the audit mechanisms and security of the systems. However, there is still no clear definition regarding the commercial aspects of these providers in relation to the rest of the market.

Thus, without specific rules for providers and certified games for use in regulated environments, the trend is for the emergence of unauthorized websites. This is because there is no administrative instrument to regulate these providers. In other words, there is regulation of the product, but there is still no complete definition of the role of those who distribute it.

How does the online gambling platform offer system work today?

Currently, there is no rule establishing specific criteria for offering games to platforms that are not authorized by the Prizes and Betting Secretariat (SPA). According to the Ministry of Treasury, the regulation of this point is foreseen in the “Regulatory Agenda 2025-2026. The agenda will include a decree focused on this issue.

The new regulation will detail how providers can operate in the country and what requirements will be applied to them, including those related to combating the illegal market. Therefore, until then, these providers continue to operate following only the technical requirements that are currently in effect.

Regarding oversight, today it focuses exclusively on the operation of irregular websites. SPA monitors search engines and social networks, contacts Anatel for blocking, and requests the removal of pages and publications.

These measures target the operation of the platforms, but do not directly address the provision of content that sustains these environments. The Ministry of Treasury expects that the new rules will standardize the process; however, there is still no date for the publication of the text.
