The National Association of Municipal and State Lotteries (ANALOME) expressed strong disagreement with the use of the “.bet.br” domain as the sole criterion for distinguishing legal from illegal betting websites. The criticism was directed at the Prizes and Betting Secretariat of the Ministry of Treasury (SPA-MF).

The entity argues that the measure adopted by SPA-MF undermines the principles of legality. It also violates free initiative and the autonomy of federative entities. Furthermore, this government action may generate legal uncertainty for operators who follow the legislation.

ANALOME argues that the requirement for the “.bet.br” domain is an arbitrary action. This action ignores the reality of the sector, where platforms accredited by state lotteries use other domains legally.

The entity also warns that this restriction could negatively impact lottery operations. These operations finance crucial areas such as health and education. In contrast, the “.bet.br” domain is exclusively intended for those who have obtained a federal license.

In an official statement, the association stated that the measure represents an attempt to maintain a monopoly on lottery operations. Furthermore, ANALOME highlighted that this is contrary to the legislation and the jurisprudence of the Federal Supreme Court (STF).

Therefore, ANALOME requests the revocation of Ordinance SPA/MF No. 566/25. Additionally, it proposes the creation of a Joint Working Group with representatives from the Prizes and Betting Secretariat. The main objective is to discuss solutions that guarantee legal certainty and respect the autonomy of states and municipalities.

Camilo Roma de Brito, President of ANALOME, said: “We believe that technical dialogue is essential to develop a fair regulatory framework. This proposal demonstrates our commitment to consensual solutions.”

The entity also advised its members to consider legal measures to protect their activities. In this sense, the possibility of filing a writ of mandamus was not ruled out.

ANALOME’s official position

The National Association of Municipal and State Lotteries – ANALOME expresses its vehement repudiation of Ordinance SPA/MF No. 566, published on March 21, 2025, by the Prizes and Betting Secretariat of the Ministry of Treasury. This rule, by establishing the “.bet.br” domain as the exclusive criterion for identifying illegal operations in the betting sector, imposes an erroneous limitation that violates the principles of legality, free initiative and autonomy of the federative entities.

The Ordinance creates an environment of legal uncertainty, harming operators who operate in accordance with current legislation. The requirement for the “.bet.br” domain disregards the reality of the sector, where several operations regulated by states and municipalities use other domains. This restriction is a violation of the principle of legality (art. 5, II, of the Federal Constitution/88) and an abuse of the legislative power of the Union.

Although the intention of the Ordinance is to combat illegality, the adopted criteria have no legal basis and jeopardize the continuity of lottery operations that finance essential areas such as health and education. The imposition of this inadequate criterion is not an adequate instrument to curb irregularities, directly impacts public policies and creates insecurity for operators and beneficiaries.

In view of this scenario, ANALOME urges the Prizes and Betting Secretariat to revoke Ordinance SPA/MF No. 566/25, correcting this serious affront to the legal system and avoiding irreparable damage to the gaming and entertainment industry, as well as advising its associates to adopt the appropriate legal measures, without ruling out the possibility of filing a Writ of Mandamus, to protect their activities.

Furthermore, the Ordinance reveals an attempt by the Prizes and Betting Secretariat to indirectly maintain a monopoly over lottery operations, which is not supported by current legislation or the case law of the Supreme Federal Court. This approach creates obstacles that favor certain agents to the detriment of state and municipal autonomy.

ANALOME reaffirms its commitment to combating illegal practices within constitutional limits and proposes the creation of a Joint Working Group with representatives from the Prizes and Betting Secretariat, to analyze the impacts of the Ordinance and seek solutions that guarantee legal security and respect the autonomy of the federative entities.

We believe that technical dialogue is essential to develop a fair regulatory framework. This proposal does not exclude guidance on appropriate legal measures, but demonstrates our commitment to consensual solutions.
