Barueri City Council approves creation of municipal lottery

Barueri, São Paulo, is close to having its own lottery. The city council approved the creation of a municipal lottery. Now, the municipality can explore public lottery services, either physically, at lottery outlets, or online.

As is the case in several municipalities in Brazil, this new measure will generate a new source of revenue for the City Hall. This revenue could improve health services, social assistance, programs that reduce social vulnerability, and strengthen the Social Solidarity Fund.

The bill was submitted by Mayor Beto Piteri (Republicans). “The municipal lottery money will strengthen the budget for essential areas and bring more benefits to the population,” reads the mayor’s justification, sent to the council members.

Additionally, prize amounts not collected within the deadline will also be returned to these priority areas.

According to Bill 38/2025, the City Hall may manage the lottery and lottery outlets directly or allow companies to do so. Minors under 18 are not allowed to purchase tickets.

A decree will define the operating rules and the form and distribution of funds. This will be based on requirements for transparency, oversight, and security to prevent fraud. After approval by the City Council, the bill will return to the mayor and will only become law after its sanction and publication in the Official Gazette of Barueri.

Supreme Court Justice Nunes Marques did not order the suspension of operations of active lotteries, awaiting positions from the Attorney General’s Office and the Public Prosecutor’s Office before deciding on precautionary measures.

Finally, the case remains under review by the Supreme Federal Court (STF) with no date set for a trial. The final decision could determine who has the right to legislate and oversee lotteries in the country.

This lawsuit stems from a lawsuit filed by the Solidariedade party, which argues that only the federal government has the authority to legislate on the matter. According to the party, several municipalities are creating their own betting systems without following federal rules established by the Ministry of Treasury.
