Court orders mandatory warning about use of Bolsa Família on betting sites


The Federal Court ruled that betting platforms must present clear notices regarding the prohibition of using amounts from social programs, such as Bolsa Família and Benefício de Prestação Continuada, in online bets.

The measure was signed by Judge Gabriel Hillen Albernaz Andrade, of the Federal Court of São Paulo on June 13. Thus, the decision complied with the request made by Educafro and the Mônica Paião Trevisan Child and Adolescent Defense Center. The organizations work to protect vulnerable groups and guarantee social rights in Brazil.

Deadline set for the online betting sector

According to Folha, the deadline for betting platforms to adapt is 45 days. This period already includes the implementation of warnings on their websites and advertising campaigns.

The determination applies to the Union, betting companies and the Brazilian Institute of Responsible Gaming (IBJR), which brings together the main websites in the sector.

Frei David, executive director of Educafro, explained: “The preliminary decision reveals the unacceptable delay of the State in fulfilling an elementary constitutional duty.

“Already recognized by the Supreme Federal Court: to protect people in a condition of hypervulnerability against the predatory action of mechanisms that have billions of reais earmarked for social protection.”

Creation of mechanisms to block the participation of Bolsa Família beneficiaries

In addition to the warnings, the organizations are requesting the creation of mechanisms to prevent beneficiaries of social programs from registering and participating in betting. To this end, lawyers are advocating the sharing of data with betting sites.

Therefore, they request that the federal government send a database containing the Individual Taxpayer Registry (CPF) numbers of Bolsa Família beneficiaries.

Frei David also stated: “It is expected that companies comply with the court decision and that the Union, as a matter of urgency, moves forward in formulating an effective public policy.”
