STF authorizes Caixa’s participation in action that defines the future of municipal lotteries in Brazil

The Federal Supreme Court (STF) took another important step in the legal imbroglio involving the regulation of games and sweepstakes in the country.

Minister Kassio Nunes Marques, responsible for reporting the case at the Court, recently granted a request made by Caixa Econômica Federal.

With the decision signed by the magistrate, the public financial institution now officially acts as amicus curiae (friend of the Court) in the process that judges the validity and structural competence for the operation of municipal lotteries.

In practice, this legal tool allows entities that are not direct parties to the action to present technical data, relevant information and in-depth perspectives to assist ministers in analyzing the case and constructing a final verdict.

Why municipal lotteries ended up at the center of a legal dispute

The controversy that reached the highest instance of the Brazilian Judiciary began through a direct action filed by the Solidariedade party.

The party therefore questions the legality of the acts of several city halls across the country that, on their own, authorized the implementation, exploration and maintenance of local lottery systems.

The central argument of the accusation maintains that municipal administrations do not have constitutional competence to legislate on this type of economic activity.

Thus, the great debate that took place in the corridors of Brasília revolves around a fundamental question of governance: who, in fact, has the legal prerogative to regulate and explore this billion-dollar market within the national territory?

The impact of the injunction and the long wait for the Supreme Court’s verdict

All this legal uncertainty had already provoked, of course, a strong intervention by the Court at the end of last year.

In December, faced with the isolated advance of city halls, rapporteur Nunes Marques issued a precautionary order suspending the operation of all municipal operations that were already underway in Brazil.

In addition to halting current activities, the measure also blocked the launch of new systems and paved the way for the application of severe fines in case of non-compliance by mayors.

Since the minister’s signature, the matter has ceased to be a mere local dispute and has thus become a key piece in the design of the entire national regulation of the betting and sweepstakes sector.

To date, the STF plenary has not defined an exact date for the final judgment on the issue, meaning that the ban decreed by the rapporteur remains in full force for an indefinite period of time.
