Provisional measure that increases taxation on sportsbooks is extended until October

The Federal Senate extended the provisional measure (MP) that increases the tax on betting houses until October 8 (MP 1,303/2025). The MP would have expired on August 9. However, the extension is automatic, as the MP is still under review by the National Congress.

The publication of the MP, in June, was on the agenda to compensate for the revocation of the IOF increase by Congress. Within the text, the MP contains a provision that increases the burden on online betting.

Taxation on revenue from fixed-odds betting (sportsbooks) increases from 12% to 18%. The rate applies to the Gross Gaming Revenue (GGR) paid by companies. In this case, it’s the difference between the total bets and the total paid in prizes and other taxes.

The commission will hold public hearings before voting on the provisional measure that increases taxation on sportsbooks.

The measure is currently under review by a joint committee of deputies and senators. The committee is chaired by Senator Renan Calheiros (MDB-AL), with Congressman Carlos Zarattini (PT-SP) as rapporteur.

The committee must hold four public hearings before the vote, which is scheduled to take place on August 26. After that, the provisional measure will be analyzed by both plenary sessions, the Chamber of Deputies and the Senate.

Initially, the MP’s extension was due to expire on October 22, but the House shortened the deadline by 14 days. According to information released by the National Congress itself, the reason for the change is that there is no official parliamentary recess this year.

According to the Constitution, legislative proceedings are suspended between July 18th and 31st, but only if Congress has approved the Budget Guidelines Bill (LDO), which has not yet happened this year. This means that the interruption of deadlines that would occur due to the recess is not implemented.
