Joint Congressional Committee to Analyze Increased Taxation on Sportsbooks and Investments

The National Congress must install, this Tuesday (15), at 2:40 pm, a joint committee (Federal Senate and Chamber of Deputies) to analyze the Provisional Measure (MP) 1,303/2025, which proposes the increase of the tax burden on sportsbooks (known as bets) and some financial applications currently exempt.

The proposal sets a 5% income tax rate for financial market investments. Currently, these investments are exempt.

These include real estate investment trusts (FII), real estate and agribusiness credit notes (LCI and LCA), and real estate receivables certificates (CRI) and agribusiness receivables certificates (CRA). Taxation on sportsbooks increases from 12% to 18%.

In addition to taxation, the MP seeks to increase federal revenue and reduce expenses, including adjustments to the Social Contribution on Net Income (CSLL).

The measure represents a new attempt by the government to adjust public accounts, after the rejection of presidential decrees 12,466/2025 and 12,467/2025, published in May and aimed at increasing the Tax on Financial Transactions (IOF).

The federal government published the Provisional Measure on June 11, accompanied by a new decree, 12.499/2025. However, at the end of the same month, Congress overturned all three decrees, reinstating the previous IOF rules.

MP 1,303/2025 remains valid for other taxes, and Congress must analyze it by August 23.

Betting sector criticized tax increase

The betting industry strongly criticized the tax change, claiming that the measure weakens licensed companies and, as a result, favors the growth of the illegal market in the country. Furthermore, companies highlighted that the regulation was only implemented on January 1, 2025, creating financial uncertainty.

STF Determination

The Supreme Federal Court (STF) determined, in July, that the Executive and Legislative branches must seek an understanding on the issue through negotiation.

Finally, the commission to be established will include senators and federal representatives. After the election of the president and the selection of the rapporteur, the parliamentarians will analyze the 679 amendments already submitted to the provisional measure.
