Senate Sports Committee to vote on bills to regulate betting advertising

The Sports Commission (CEsp) will hold a meeting next Wednesday (21), at 10:30 am, with five items on the agenda, including two projects on the regulation of advertising for sports betting, known as bets.

The first bill (PL 2.985/2023), originally proposed by Senator Styvenson Valentim (PSDB-RN), proposed a total ban on advertising for sports lotteries. However, Senator Carlos Portinho (PL-RJ) revised the text, authorizing the broadcast of advertisements only between 10 pm and 6 am on radio and television, maintaining the restriction for the internet and other media.

The second bill, presented by Senator Eduardo Girão (Novo-CE), aims to prohibit celebrities from participating in sports betting advertisements (PL 3,405/2023). Therefore, Senator Sérgio Petecão (PSD-AC), rapporteur of the proposal, included referees and former referees in the list of personalities prohibited from promoting bookmakers.

If approved by CEsp, the projects will be analyzed by the Communication and Digital Law Commission (CCDD), which will make the final decision on them.


Public hearing held in April discussed limitations on betting advertising

On April 23, the Sports Commission held a public hearing to debate bills that aimed to restrict advertising for online betting.

During the session, two projects were discussed. The first, Bill 2,985/2023, proposed banning the advertising of these betting services. The second, Bill 3,405/2023, sought to ban athletes and celebrities from promoting sports betting platforms.

This meeting was held at the request of Senators Carlos Portinho (PL-RJ) and Jorge Kajuru (PSB-GO). Senator Styvenson Valentim (PSDB-RN), author of the first bill, argued that, considering the economic power accumulated by betting companies, it would be the role of the Legislature to establish limits on such activity. Carlos Portinho acted as rapporteur for the proposal.

On the other hand, Bill 3,405/2023, authored by Senator Eduardo Girão (Novo-CE) and reported by Senator Sérgio Petecão (PSD-AC), had a similar objective. The bill also included a ban on advertising by sports teams, athletes, former athletes, presenters or commentators of any sport and media outlet. This measure aimed to limit the influence of these figures in the promotion of sports betting.
