Defesa do Consumidor: Procon-SP aplica multa milionária a PIXBET

The Procon Federation of the State of São Paulo (Procon-SP) applied a fine to the bookmaker Pixbet in the amount of R$1,127,820.00.

According to Procon-SP itself, the punishment applied is based on financial information identified by the Foundation’s experts, as established by the Consumer Protection Code. Pixbet has the right to appeal the sanction.

The statement published on the São Paulo Procon website last Wednesday (19) brought bad news for Pixbet.

According to the text, the betting company‘s websites contain several abusive clauses in the contractual instrument “Terms and Conditions”, which leave consumers at an excessive disadvantage.

The motives for punishment:

One example cited concerns the permission given to the company to “unilaterally modify the content of the contract after its conclusion and without prior communication to the consumer”.

Furthermore, another point set out by the agency is the fact that the company “prevents the withdrawal of deposited and unused amounts”. In the experts’ analysis, this fact ends up “taking away from the consumer the right to a refund of the amount paid”.

According to the text, the “terms and conditions” available on the Pixbet website limit the consumer. “It limits the amount the consumer can withdraw, preventing them from using their resources.”

In the text, the São Paulo agency further details: “The consumer is obliged to exonerate the company from objective liability regarding the platform services that gave rise to the consumer’s complaint.”

And it continues: “as well as assuming the obligation to reimburse any collection costs, without the same right being granted to the consumer in relation to the supplier”.

In the action, the agency reinforces the need for greater oversight of the betting sector. It also highlights the importance of transparency and respect for consumer rights in the digital environment.

However, Pixbet is among the betting companies that are licensed and operating within the regulations that came into effect on January 1, 2025.
