The Minister of the Supreme Federal Court (STF), Luiz Fux, rapporteur of ADI No. 7,721, has just partially granted a precautionary request made by the National Association of Games and Lotteries (ANJL).
Fux’s decision mandates the suspension of operational obligations that required the blocking and compulsory closure of already active accounts of users benefiting from social programs, such as Bolsa Família and the Continuous Benefit Payment (BPC), until the conciliation hearing takes place.
In practical terms, this means that users who were blocked between December 1st and this Friday (19th) will be able to have their restrictions lifted and re-register on the platforms.
However, the ban on new registrations or the opening of new accounts remains in effect, in accordance with Normative Instruction No. 22/2025 of the Secretariat of Prizes and Bets of the Ministry of Treasury (SPA-MF).
“I partially grant the precautionary request so that, until the scheduled conciliation hearing takes place, the effectiveness of the operational obligations that imply the blocking and compulsory closure of already active accounts is suspended, while maintaining the prohibition on the creation of new accounts or the opening of new accounts,” states Fux’s decision.
Early conciliation hearing
Furthermore, the conciliation hearing was brought forward from February 17th to February 10th, 2026, when the appropriate method for complying with the precautionary measure will be analyzed.
Therefore, ANJL informs that it continues to act institutionally and technically in defense of the regulated market and will keep its members informed of new developments.
