{"id":230354,"date":"2026-06-12T14:38:12","date_gmt":"2026-06-12T17:38:12","guid":{"rendered":"https:\/\/igamingbrazil.com\/nao-categorizado\/2026\/06\/12\/tce-pr-warns-that-municipal-lotteries-should-not-be-created-until-the-stf-decides\/"},"modified":"2026-06-12T17:11:12","modified_gmt":"2026-06-12T20:11:12","slug":"tce-pr-warns-that-municipal-lotteries-should-not-be-created-until-the-stf-decides","status":"publish","type":"post","link":"https:\/\/igamingbrazil.com\/en\/legislation-en\/2026\/06\/12\/tce-pr-warns-that-municipal-lotteries-should-not-be-created-until-the-stf-decides\/","title":{"rendered":"TCE-PR warns that municipal lotteries should not be created until the STF decides"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The city halls of Paran\u00e1 received legal guidance from the <strong><a href=\"https:\/\/www.tce.pr.gov.br\/\">Court of Auditors of the State of Paran\u00e1 (TCE-PR).<\/a><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Municipalities are formally instructed <strong>not to establish any municipal lottery or approve new local legislation on this market<\/strong> until the <strong><a href=\"https:\/\/igamingbrazil.com\/en\/legislation-en\/2026\/05\/20\/action-in-the-stf-challenges-state-law-that-vetoes-lottery-advertising-in-rio-grande-do-sul\/\">Federal Supreme Court (STF) <\/a><\/strong>completes the <strong>definitive judgment on Claim of Non-Compliance with Fundamental Precept (ADPF) No. 1212.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The guideline was established after the <strong>city council of Corn\u00e9lio Proc\u00f3pio<\/strong> filed a technical consultation to understand whether its <strong>Law No. 600\/24, which authorized the local exploitation of games, had legal validity or would face direct constitutional barriers.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\">Why the creation of a municipal lottery comes up against federal limits<\/h2>\n\n<p class=\"wp-block-paragraph\">The central complexity of this issue involves the<strong> division of powers established in the Federal Constitution.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Historically, the STF had already decided that the<strong> Union has the exclusive and exclusive competence to legislate on rules for draws and consortia in the country.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Although the Court guaranteed state governments and the Federal District the<strong> right to explore lottery services in their territories to boost revenue<\/strong>, city halls were <strong>not included in this administrative authorization by Federal Law No. 13,756\/18.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Assessing the scenario, the <strong>Attorney General&#8217;s Office (AGU)<\/strong> argues that the <strong>exploitation of games poses serious risks to the socioeconomic order and the protection of minors,<\/strong> requiring <strong>extremely rigorous supervision that restricts the operation to the federal and state spheres.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Municipalities only have the prerogative of<strong> receiving portions of the financial transfers collected by other government entities.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\">The waiting period for the judgment at the Supreme Court<\/h2>\n\n<p class=\"wp-block-paragraph\">When analyzing the specific case, the <strong>advisor and rapporteur of the process at TCE-PR, Durval Amaral<\/strong>, openly acknowledged that <strong>city halls face tight budgets<\/strong> and that the <strong>search for new sources of revenue to invest in sensitive areas, such as health and education, is an urgent issue.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">However, the judge highlighted that<strong> the rules created in isolation by cities end up invading the exclusive legislative competence of the Union.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">As <strong>ADPF n\u00ba 1212 is currently being processed by the STF, debating exactly the legality and autonomy of these initiatives spread across the country&#8217;s municipalities<\/strong>, the Paran\u00e1 court defined that the <strong>most prudent administrative stance is to paralyze any local progress.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The unanimous<strong> technical decision recently became final, in April 2026,<\/strong> establishing a provisional jurisprudence that <strong>halts the bureaucratic advancement of the sector within the city halls until the final outcome in Bras\u00edlia.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The city halls of Paran\u00e1 received legal guidance from the Court of Auditors of the State of Paran\u00e1 (TCE-PR).
