{"id":222204,"date":"2026-03-31T12:55:33","date_gmt":"2026-03-31T15:55:33","guid":{"rendered":"https:\/\/igamingbrazil.com\/nao-categorizado\/2026\/03\/31\/betting-taxes-expected-to-jump-to-42-and-threaten-operations\/"},"modified":"2026-03-31T13:53:38","modified_gmt":"2026-03-31T16:53:38","slug":"betting-taxes-expected-to-jump-to-42-and-threaten-operations","status":"publish","type":"post","link":"https:\/\/igamingbrazil.com\/en\/legislation-en\/2026\/03\/31\/betting-taxes-expected-to-jump-to-42-and-threaten-operations\/","title":{"rendered":"Betting taxes expected to jump to 42% and threaten operations"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <strong>second year of operation of the regulated fixed-odd betting market in Brazil <\/strong>consolidates robust numbers inherited from 2025, with <strong>83 licensed companies<\/strong>, <strong>29.4 million active users<\/strong> and <strong>R$37 billion collected into public coffers.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">However, a new study by <strong>LCA Consultoria<\/strong>, commissioned by the <a href=\"https:\/\/ibjr.org.br\/\">Brazilian Institute of Responsible Gaming (IBJR)<\/a>, raises a warning for the sector: <strong>the progression of Tax Reform will increase the tax burden on legal operators from 32% to 42% by 2033.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">In this sense, for the industry, the key to increasing state revenue should<strong> focus on repressing illegal activity, and not on the financial suffocation of formal platforms that have already received grants of R$30 million.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\">How escalating taxes threaten the viability of legal operators<\/h2>\n\n<p class=\"wp-block-paragraph\">The LCA projection details that <strong>the<\/strong> replacement of taxes such as the <strong>Social Integration Program (PIS\/Cofins) and the Service Tax (ISS) with the new Tax on Goods and Services (IBS) and Contribution on Goods and Services (CBS) will weigh disproportionately on <a href=\"https:\/\/igamingbrazil.com\/online\/2024\/03\/11\/o-que-e-igaming\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"igaming\">iGaming<\/a> companies.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">According to <strong>Eric Brasil, director of the consultancy<\/strong>, the sector will be<strong> 14 percentage points above the base rate of 28% predicted by the Ministry of Treasury.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Added to this, <strong>social allocation rates will jump from the current 13% to 15%.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Pl\u00ednio Lemos Jorge, president of the <a href=\"https:\/\/igamingbrazil.com\/en\/nao-categorizado\/2025\/06\/13\/anjl-and-ibjr-mobilize-to-defend-the-legalized-betting-sector-in-the-country\/\">National Association of Games and Lotteries (ANJL)<\/a>,<\/strong> warned about the risk of <strong>driving investments away from the country.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">&#8220;If the rules of the game don&#8217;t change, it can continue like this, because that&#8217;s what the houses that came to Brazil were willing to do,&#8221; he explained.<\/p>\n\n<p class=\"wp-block-paragraph\">&#8220;If it starts to always increase by 1% to 2%, soon there will no longer be a viable operation. Because companies arrive in Brazil based on a premise, it would be a breach of trust to change the rules of the game in the middle of the championship&#8221;, said the executive.<\/p>\n\n<h2 class=\"wp-block-heading\">The risk of Selective Tax and the involuntary promotion of the clandestine market<\/h2>\n\n<p class=\"wp-block-paragraph\">The sustainability of federal revenue is directly linked to the <strong>competitiveness of the legalized market.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Andr\u00e9 Gelfi, director and co-founder of IBJR,<\/strong> highlighted that <strong>passing on excessive tax costs to the product will inevitably push consumers to illegal websites.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">On the other hand, the data prove that the crackdown on piracy is highly profitable for the government: <strong>each 5% advance in market formalization injects around R$1 billion additional into the public coffers.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">&#8220;The study showed that for every 5 percentage points of market formalization, the country could raise around R$1 billion additionally&#8221;, he pointed out.<\/p>\n\n<p class=\"wp-block-paragraph\">Another critical point on the horizon for operators is the i<strong>ncidence of the Selective Tax (the so-called &#8220;sin tax&#8221;), scheduled for 2027.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Gelfi argued that the taxation<strong> reflects a legislative lack of knowledge about the nature of fixed-odds bets<\/strong>, which differ drastically from state-run lotteries, where the government retains the majority of the amount collected.<\/p>\n\n<p class=\"wp-block-paragraph\">&#8220;Due to ignorance, they want to apply the same dynamics with betting&#8221;, concluded the director, reinforcing the urgency of protecting the legal ecosystem.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The second year of operation of the regulated fixed-odd betting market in Brazil consolidates robust numbers inherited from 2025, with 83 licensed companies, 29.4 million active users and R$37 billion [&hellip;]<\/p>\n","protected":false},"author":34,"featured_media":222170,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3130],"tags":[16989,14945,6730],"class_list":["post-222204","post","type-post","status-publish","format-standard","has-post-thumbnail","category-legislation-en","tag-apostas-en","tag-tax-reform","tag-taxes"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
