{"id":194387,"date":"2025-07-14T14:00:51","date_gmt":"2025-07-14T17:00:51","guid":{"rendered":"https:\/\/igamingbrazil.com\/nao-categorizado\/2025\/07\/14\/joint-congressional-committee-to-analyze-increased-taxation-on-sportsbooks-and-investments\/"},"modified":"2025-07-14T15:13:41","modified_gmt":"2025-07-14T18:13:41","slug":"joint-congressional-committee-to-analyze-increased-taxation-on-sportsbooks-and-investments","status":"publish","type":"post","link":"https:\/\/igamingbrazil.com\/en\/legislation-en\/2025\/07\/14\/joint-congressional-committee-to-analyze-increased-taxation-on-sportsbooks-and-investments\/","title":{"rendered":"Joint Congressional Committee to Analyze Increased Taxation on Sportsbooks and Investments"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <strong>National Congress <\/strong>must install, this Tuesday (15), at 2:40 pm, a<strong> joint committee<\/strong> (<a href=\"https:\/\/www12.senado.leg.br\/hpsenado\">Federal Senate<\/a> and <a href=\"https:\/\/www.camara.leg.br\/\">Chamber of Deputies<\/a>) to analyze the<strong> Provisional Measure (<a href=\"https:\/\/igamingbrazil.com\/en\/legislation-en\/2025\/06\/26\/congress-blocks-iof-increase-and-sends-message-against-mp-that-increases-betting-taxation\/\">MP<\/a>)<\/strong> 1,303\/2025, which proposes the increase of the tax burden on <strong>sportsbooks <\/strong>(known as bets) and some<a href=\"https:\/\/www.congressonacional.leg.br\/\"> financial applications currently exempt.<\/a><\/p>\n\n<p class=\"wp-block-paragraph\">The proposal sets a 5% income tax rate for financial market investments. Currently, these investments are exempt.  <\/p>\n\n<p class=\"wp-block-paragraph\">These include real estate investment trusts (FII), real estate and agribusiness credit notes (LCI and LCA), and real estate receivables certificates (CRI) and agribusiness receivables certificates (CRA). Taxation on sportsbooks <strong>increases from 12% to 18%<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In addition to taxation, the MP seeks to <strong>increase federal revenue<\/strong> and <strong>reduce expenses<\/strong>, including adjustments to the <strong>Social Contribution on Net Income<\/strong> (CSLL). <\/p>\n\n<p class=\"wp-block-paragraph\">The measure represents a new attempt by the government to adjust public accounts, after the rejection of presidential decrees <strong>12,466\/2025 <\/strong>and <strong>12,467\/2025<\/strong>, published in May and aimed at increasing the <strong>Tax on Financial Transactions (IOF)<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">The federal government published the Provisional Measure on <strong>June 11,<\/strong> accompanied by a new decree, <strong>12.499\/2025<\/strong>. However, at the end of the same month, Congress overturned all three decrees, reinstating the previous IOF rules.  <\/p>\n\n<p class=\"wp-block-paragraph\">MP 1,303\/2025 remains valid for other taxes, and Congress must analyze it by August 23.<\/p>\n\n<h2 class=\"wp-block-heading\">Betting sector criticized tax increase<\/h2>\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/igamingbrazil.com\/en\/nao-categorizado\/2025\/06\/13\/anjl-and-ibjr-mobilize-to-defend-the-legalized-betting-sector-in-the-country\/\">betting industry<\/a> strongly criticized the tax change, claiming that the measure weakens licensed companies and, as a result, favors the growth of the illegal market in the country. Furthermore, companies highlighted that the regulation was only implemented on January 1, 2025, creating financial uncertainty.  <\/p>\n\n<h2 class=\"wp-block-heading\">STF Determination <\/h2>\n\n<p class=\"wp-block-paragraph\">The <strong>Supreme Federal Court (STF) <\/strong>determined, in July, that the Executive and Legislative branches must seek an understanding on the issue through negotiation.<\/p>\n\n<p class=\"wp-block-paragraph\">Finally, the commission to be established will include <strong>senators and federal representatives<\/strong>. After the election of the president and the selection of the rapporteur, the parliamentarians will analyze the <strong>679 amendments<\/strong> already submitted to the provisional measure.
