{"id":144140,"date":"2024-03-20T13:23:12","date_gmt":"2024-03-20T16:23:12","guid":{"rendered":"https:\/\/igamingbrazil.com\/uncategorized\/2024\/03\/20\/lottopar-joins-class-action-because-of-loterj\/"},"modified":"2024-03-20T13:28:19","modified_gmt":"2024-03-20T16:28:19","slug":"lottopar-joins-class-action-because-of-loterj","status":"publish","type":"post","link":"https:\/\/igamingbrazil.com\/en\/lottery-en\/2024\/03\/20\/lottopar-joins-class-action-because-of-loterj\/","title":{"rendered":"Lottopar joins class action because of LOTERJ"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Lottopar<\/strong> joined as an interested party in a class action in the State Court of Rio de Janeiro against <strong>LOTERJ<\/strong>, the Rio de Janeiro<a href=\"https:\/\/igamingbrazil.com\/en\/lottery-en\/\"> lottery<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state public company in Paran\u00e1 seeks to preserve market stability and guarantee legal security for operators and bettors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But although it is not the holder of the action, Lottopar highlights its commitment to complying with current legislation and respecting territoriality.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Lottopar joined the lawsuit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Federal Supreme Court, recognizing the<a href=\"https:\/\/igamingbrazil.com\/en\/lottery-en\/\"> lottery<\/a> as a public service, determined that its operation must comply with the territorial limits of each federative entity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before Law No. 14,790\/2023, authorities limited the operation of the lottery to state and national territories, as necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Below is <strong>Article 35-A of Law No. 14,790\/2023:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Art. 35-A<\/strong>. The States and the Federal District are authorized to operate, within their territories, only the lottery modalities provided for in federal legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7<\/strong> <strong>4\u00ba <\/strong>Lottery marketing and advertising by the States or the Federal District carried out in physical, electronic or virtual media <strong>will be restricted to people physically located within the limits of their districts or those domiciled within their territoriality<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, with the new law, the States and the Federal District are authorized to explore only the lottery modalities provided for in federal legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the marketing and advertising of lotteries is restricted to the limits of their districts or to those domiciled within their territories.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/igamingbrazil.com\/en\/lottery-en\/2024\/02\/23\/loterj-becomes-a-regular-member-of-cibelae\/\">LOTERJ<\/a><\/strong>, in turn, created a legal fiction of territoriality through a notice. In other words, it will allow bets made in any part of Brazil to be considered in the territory of the State of Rio de Janeiro.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <strong>Lottopar<\/strong> reaffirms that only<strong> bettors physically located in the territory of Paran\u00e1<\/strong> can place<a href=\"https:\/\/igamingbrazil.com\/en\/sports-betting-en\/\"> sports bets <\/a>on sites authorized by Lottopar or on federally licensed betting sites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, operators without a Lottopar license, federal license or license from other states, who wish to offer <a href=\"https:\/\/igamingbrazil.com\/en\/sports-betting-en\/\">sports betting<\/a> in Paran\u00e1, are acting illegally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this way, Lottopar reiterates its commitment to legality and respect for current regulations, ensuring a safe and regulated environment for bettors and operators.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lottopar joined as an interested party in a class action in the State Court of Rio de Janeiro against LOTERJ, the Rio de Janeiro lottery.
