The City Council of Avaré, in the state of São Paulo, approved last week a bill authorizing the creation of a municipal lottery. The bill was introduced by Mayor Roberto de Araújo of the Liberal Party (PL) and received six votes in favor and five against.
Bill No. 174/2025 provides that the municipality may directly manage or grant the operation of lotteries and gambling games permitted by federal law. Responsibility for regulating, controlling, and overseeing lottery activities will fall under the municipal administration.
As established in the document, the operation of lottery services may be delegated to specialized companies through concessions, provided that the rules stipulated by federal law are respected. More details on how the new law operates are listed below.
How will the municipal lottery be granted?
The text determines that the concession of services will be granted through a competitive bidding process, in accordance with Federal Law No. 14,133/2021, known as the New Law on Public Tenders and Contracts. The concession will have a 20-year term, with the possibility of renewal depending on the public interest.
The project establishes that the resources raised by the operation of the municipal lottery will be allocated primarily to the areas of public health, education, public safety, social assistance, culture and sports.
Furthermore, lottery services will be subject to the Tax on Services of Any Nature (ISS), with a rate of 5% applied to the gross revenue generated by the operations.

Supervision of activities will be the responsibility of the Municipal Finance Department, which may enter into agreements with public or private entities to ensure compliance with the standards set forth by law.
The Internal Control sector will be responsible for carrying out periodic audits, ensuring transparency and legality in the management of resources from lotteries.

According to the text, after publication, the municipality will have 90 days to regulate the law, which will come into effect immediately after publication.
During the session, the vote was symbolic and debated in a single round. The result was six votes in favor and five against, formalizing the project’s approval.
