The SP Loterias Consortium was officially declared the winner of the bid for the concession of public lottery services in the State of São Paulo. The confirmation took place last Monday (2), with the publication of the minutes of the International Competition SPI No. 01/2024 in the Official Gazette.
The Investment Partnerships Secretariat (SPI), responsible for the process, validated the group’s qualification after a complete analysis of the documentation required in the notice.
As stated in the document, companies that participated in the competition have until the third business day after the publication of the extract in the Official Gazette to file an appeal against the decisions of the Contracting Committee.
The dispute attracted two consortia and required a high investment
The bidding attracted two interested consortia in October of the previous year. The proposals were submitted on October 28, and the public bidding session took place on November 1, at the B3 headquarters in São Paulo. The process is conducted by Companhia Paulista de Parcerias (CPP), a member of SPI.
The competing groups were the Aposta Vencedora Consortium, led by SAV Participações and AX4B Sistemas de Informática, and the SP Loterias Consortium, formed by IGT Global Services and Scientific Games, the latter already responsible for operating the Minas Gerais lottery. The concession contract has a duration of 15 years and requires an investment of R$333 million.
Highest award criterion defined the winner
The winner was determined by the highest amount offered as a fixed concession, which had to exceed the minimum of R$260.7 million. Variable concessions were also expected during the concession term, estimated at R$3.4 billion.
The concession covers modalities such as specific forecast lottery (including sports and numerical forecast games), instant lottery (scratch card) and passive lottery (with numbered tickets). Fixed-odds bets and online games were left out of the scope of the concession.
In the first bidding result, the Aposta Vencedora Consortium, made up of Brazilian companies, won by offering a fixed grant of R$600 million, exceeding the minimum with a premium of 130.15%.
The SP Loterias Consortium initially proposed R$486,538,006.00, with a premium of 86.63%. As the difference between the proposals was less than 5%, it was necessary to hold a round of verbal bids. After four bids, the group led by Portuguese companies outbid its opponent.
However, on May 8 of this year, the Aposta Vencedora Consortium was disqualified for failing to pay the R$600 million proposed as a concession fee. Thus, the second-placed bidder was called to take over the concession, presenting an updated proposal of R$526.5 million.
On the same day, the State Secretary of Partnerships and Investments, Rafael Benini, published in the Official Gazette the exclusion of the first consortium. The start of the analysis of the qualification documents of the SP Loterias Consortium was also made official.
The 15-year contract includes obligations such as the creation of 31 exclusive points of sale and compliance with quality indicators. On the other hand, there is flexibility regarding pricing, marketing strategy and the structure of lottery services.
Therefore, the project also foresees the possibility of installing up to 11 thousand non-exclusive points throughout the state, in addition to the digital operation of the games.

The Contracting Committee, constituted by Joint Resolution SPI/ARSESP No. 01, of July 25, 2024, published in the Official Gazette of the State of São Paulo on July 26, 2024, responsible for conducting International Competition No. 01/2024, which has as its object the concession of public lottery services of the State of São Paulo, DECLARES, after analysis and judgment of the qualification documentation, QUALIFIED and, consequently, WINNER of the Auction to Bidder CONSÓRCIO SP LOTERIAS, for having fully and satisfactorily met all the conditions and requirements of the Notice.
Bidders may appeal the decisions of the Contracting Committee, pursuant to item 17 of the Notice, until 11:59 p.m. on the third business day following the publication of this Extract in the Official Gazette of the State of São Paulo.
