ARSP begins public consultation for regulation of the Espírito Santo Lottery


The Espírito Santo Public Services Regulatory Agency (ARSP) opened a call for proposals on Monday (02) to draft the resolution that will define the general conditions of the state lottery services. The process represents an important step in the implementation of the Espírito Santo Lottery.

In addition, it seeks to gather contributions from experts, regulatory bodies, private companies and other interested parties. The deadline for submitting suggestions ends on June 30, 2025. This initiative aims to build the regulatory framework for the sector in a participatory manner.

Tatiana Oliveira, Lottery Director at ARSP, stated: “This is a fundamental step to ensure that the regulation of the Capixaba Lottery is constructed in a transparent, democratic way and aligned with the best practices in the sector.

We want to listen to society and experts to develop a robust regulatory framework that ensures efficiency, integrity and social responsibility in the operation of the state lottery.”

Legal basis of the Capixaba Lottery defines Banestes as operator and ARSP as regulator

The action is part of ARSP’s regulatory agenda for 2025/2027 and follows the guidelines of Complementary Law 1,069/2023, which regulated the state lottery service. This legislation delegated to Banestes Loterias S.A. the operation of the legalized modalities, while ARSP assumed responsibility for the regulation, control and inspection of the sector.

Decree 5,931-R/2025 establishes the agency’s specific attributions, which include the creation of complementary standards, the supervision of the lottery plan and the implementation of actions aimed at preventing gambling addiction.

How to send contributions

The electronic form is available on the ARSP website and addresses fundamental issues regarding technical requirements, risks and governance. In addition, the document covers topics such as transparency, innovation and other relevant points to ensure adequate regulation of the sector.

Both individuals and legal entities can participate in the public consultation. To contribute, simply access the agency’s website and locate the social participation/subsidy-taking section. Suggestions will be accepted until 11:59 p.m. on June 30, 2025.

After the deadline, the Lottery Regulation Working Group will carefully analyze all contributions received. This information will then serve as a basis for creating the resolution that will establish the rules for the Espírito Santo lottery service.

Subsequently, ARSP will prepare a report consolidating all the submissions submitted, which will be available on the agency’s official website. This document will include the names of the authors and their respective proposals, although sensitive personal data will be duly preserved.

Through this participatory process, the agency hopes to identify specific needs and improve existing oversight mechanisms. As a result, this initiative will significantly strengthen public trust in this new modality of state service.

It is worth noting that the public consultation has a solid legal basis in paragraph 3 of article 18 of Complementary Law No. 827/2016, as well as in article 69, item I, of ARSP Resolution No. 071/2024. Therefore, the main objective is to collect qualified subsidies to prepare the resolution that will regulate lottery services in Espírito Santo.
