Brazilians have a special fondness for betting games. The OABRJ Special Commission on the Law of Sports Games, Lotteries and Entertainment held an event this Tuesday, 10th, exploring the role of state lotteries in driving new business for social and economic development in Brazil.

Those responsible for opening the meeting were the president and vice-president of the commission, Paulo Horn and Marcelo Corrêa; and members Filipe Alves, also director of the Sports Management Institute (IGE), and Leandro Pamplona.

For Filipe Alves, it is necessary to analyze the laws and jurisprudence when dealing with business involving lottery outlets.


“The lottery market is established and mature. Generally, this public does not migrate as in other markets, there is no customer abandonment and this generates profitability”, observed the IGE director.

“Since these characteristics exist, it is important that we have a way of studying the management of lotteries not only from a legal perspective, but also from an administrative perspective. To achieve this objective, business can no longer be approached as it was done in the past, although the purpose of lotteries, legally, is the social side.”

Regarding the provision of public services by state lotteries, the president of the Rio de Janeiro State Lottery (Loterj), Hazenclever Lopes Cançado, recalled the rules that aim to regulate gaming in the country.

“The strengthening and operation of all state lotteries is necessary to regulate the sector and the market. Loterj does not intend to be unanimous, we know that there are differences of opinions and they are part of the maturity to work in this area”, assessed the Loterj manager.

“Today we are again discussing the possibility of a future that is not enough, with the market always about to be regulated, in which we have Provisional Measure 1,182, from 2023 and Bill 3,626, also from 2023, being processed in the Federal Senate”.


“Even with ADPFs 492 and 493 giving us peace of mind to operate in the market, it is still very little to be able to operate in an authority like Loterj in a transparent, democratic and republican way, as was done at the forefront of the largest state lottery. from the country”.

The guests’ presentations focused on the activities of state lotteries in the current scenario of uncertainty. Among the points highlighted were the attribution of the Federal Supreme Court for the legal security of new businesses; the normative competence over sports betting: what is a general rule and what is a specific rule in Law 13,756, of 2018; and promotion to boost social development in Brazil.

Those responsible for the lectures were the executive director of Hebara Produtos Lotéricos, Amilton Noble; the member of the OABRJ Special Committee on the Law of Sports Games, Lotteries and Entertainment, Luiz Eduardo Guimarães; lawyer Rafael Biasi; the president of the OABMA Gaming Commission, Jhonatas Mendes Silva; and Loterj’s chief legal advisor, Juliana de Albuquerque.

“After the STF decision, for the state lottery, legal uncertainty is almost minimal. Today the current market scenario shows that the decisions made back then followed the right path”, said Noble.

“We fought so hard to have strong state lotteries. The worst scenario is the state of São Paulo, for example. With 45 million inhabitants and more than 640 municipalities, state lotteries cannot be stopped for three years. This is bad for operators and for society as a whole.”


According to the executive director of Hebara Produtos Lotéricos, the states have specific opportunities for action.


“I see the states as a great opportunity and in a ‘grey’ market scenario, if there is no governance model, it cannot work. It is necessary to understand that public treatment is different from private treatment. So I congratulate OABRJ for providing this open forum to debate lotteries”, said Amilton Noble.
