The Ministry of Treasury has initiated an important public consultation for the betting sector. The measure, published in the Official Gazette of the Union this Monday (23), seeks to review how payments of resources destined for sports entities will be operationalized. This initiative directly affects fixed-odds betting operators in the country.
The Prizes and Betting Secretariat (SPA) published through the Public Consultation Notice SPA/MF No. 2/2025. The document establishes a period of 45 days to receive contributions from society. In addition, the consultation covers fundamental issues on image rights and intellectual property in sport.

The Secretary of Prizes and Bets, Regis Dudena, signed the published notice. This measure follows the guidelines established by Law No. 13,756 of 2018. Furthermore, it considers the changes introduced by Law No. 14,790 of 2023.
The consultation addresses two main points of allocation of resources. First, it deals with the private entities mentioned in article 30 of the current legislation. Second, it covers the image rights and intellectual property of athletes.
The private entities included are those designated in the specific paragraphs of the law. On the other hand, image rights involve Brazilian athletes and sports organizations. Therefore, the review may significantly impact the current distribution model.
The consultation period opened on 19 June 2025. Consequently, contributions will be accepted until 2 August 2025. Any natural or legal person can participate in the process.
Participation takes place through the Participa + Brasil Portal. Access is available through the official federal government link. This ensures transparency and broad social participation in the process.
After the deadline, the SPA will analyze all the received statements. The analysis will follow the procedures established in Decree No. 12,002 of 2024. Finally, the contributions will help define the new operationalization model.

NOTICE OF PUBLIC CONSULTATION SPA/MF Nº 2/2025
THE SECRETARY OF PRIZES AND BETS OF THE MINISTRY OF FINANCE, in the exercise of the powers conferred upon him by art. 55, caput, item I, of Annex I to Decree No. 11,907, of January 30, 2024, and in view of the provisions of Law No. 13,756, of December 12, 2018, in Law No. 14,790, of December 29, 2023 and in art. 29 of Decree No. 12,002, of April 22, 2024, communicates:
Art. 1º A public consultation is open on the review of the form of operation and payment of the following amounts due by fixed-odds betting operators as referred to in art. 30 of Law No. 13,756 of December 12, 2018, with the amendments of Law No. 14,790 of 2023:
I – allocations to private entities named in art. 30, § 1º-A, item III, subitems “b, “c”, “d”, “e”, “f”, “g” and “j” and item VII, subitems “a”, “b” and “c”, of Law No. 13,756, of December 12, 2018; and
II – allocations in exchange for the image and intellectual property rights of athletes and sports organizations referred to in art. 30, § 1º-A, item III, letter “a”, §§ 6º and 7º of Law No. 13,756, of December 12, 2018.
§ 1º The public consultation referred to in the caput will last forty-five days, starting on June 19, 2025 and ending on August 2, 2025.
§ 2 Any natural or legal person may participate in the public consultation referred to in the caput through the Participa + Brasil Portal, accessible via the link https://www.gov.br/participamaisbrasil/spamf-consultapublica-destinacoes-arrecadacaodeapostas.
Art. 2º Once the period referred to in § 1º of art. 1º has ended, the received statements will be analyzed by the Prizes and Betting Secretariat of the Ministry of Treasury, in the manner established in the sole paragraph of art. 31 of Decree nº 12.002, of April 22, 2024.
