SPA lança consulta pública sobre segunda fase da agenda regulatória

The Prizes and Betting Secretariat (SPA) launched a public consultation on its regulatory agenda for the 2025-2026 biennium. The first stage of online betting regulation was completed in 2024.

With the entry into force of the regulated market on January 1, 2025, the process of applying and evaluating the rules created began.

To define which topics should enter the second phase of the regulatory agenda, SPA published its proposal with a schedule, opening space to listen to the population, companies in the sector, consumers, professionals and all interested parties in society.

As a regulatory body, the performance of SPA activities is cyclical, and it is always necessary to assess action needs, improvements and adjustments within its scope of competence.

According to the Secretary of Prizes and Bets, Regis Dudena, sector regulation needs to be observed in practice and can always be improved.

“We created a framework of main rules, quite complete and essential for the start of the functioning of the regulated fixed-odd betting market, but regulation is a cycle; There are always points to be reviewed and improved”, he explained.

Furthermore, the manager reinforced the speed of changes in this new market and the importance of social participation. “As the betting market is technological, it is very dynamic, and regulation must always be attentive to new needs that arise. We want to invite society to express its opinion on the regulatory agenda.”

Regulatory agenda

Therefore, the public consultation will be via the Participa + Brasil Platform, and experts, sector entities and citizens will have 45 days to make written contributions — until March 27th.

Furthermore, on February 21st, there will be an online public hearing on the topic, with registration via electronic form.

On April 4th, the 2025-2026 Regulatory Agenda is scheduled to be published, already taking into account the contributions collected in the consultation.

Other points of responsibility of the Secretariat are also on the Agenda put out for consultation, such as the regulation of commercial promotions, the Exclusive Instant Lottery (Lotex) and the capture of popular savings.

In the agenda proposed by the SPA, the first item will be the construction of a national system for excluded and self-excluded bettors.

The objective is to inform both people prohibited from betting by law, such as athletes and SPA employees, for example, as well as people who, of their own free will, do not want to participate in or receive betting communications or advertising.

Therefore, the regulatory agenda also has 13 other topics.

Balance

To date, 349 authorization requests have been made by companies, which resulted in an analysis of more than 45 thousand documents. R$2.1 billion were collected in payment for authorization grants.

From October to date, SPA-MF requested the National Telecommunications Agency (Anatel) to block 11,555 illegal websites. In January alone, 75 inspection actions were carried out – 51 of them related to digital influencers. In February, 22 inspections were carried out so far.

Thus, the SPA-MF Undersecretary of Monitoring and Inspection, Fabio Macorin, highlighted that the inspection team constantly monitors social networks and notifies those who commit infractions, which may evolve into more serious punishments provided for in the legal system.

“We have a specific channel with Meta, which has been a close partner of ours in this inspection activity. Allowing us to directly communicate profiles that are acting incorrectly. When we identify criminal offenses, we pass them on to the competent authorities so that they can initiate criminal proceedings”, he concluded.
