Prefeitura de Bodó contesta alerta da Fazenda sobre credenciamento de bets

Last week, the Ministry of Treasury notified Bodó City Hall, in Rio Grande do Norte, about a bidding notice for the accreditation of passive lottery and forecast companies.

The ministry requested the suspension of the notice, highlighting that, in Brazil, only the Union, States and Federal District are authorized to place bets and distribute prizes. Between October and December last year, the municipality registered 38 players interested in operating games.

According to IBGE data, Bodó has only 2,363 inhabitants. In other words, one betting company for every 63 residents. In an official note, the Municipal Administration contested the Treasury’s notification and stated that it will continue with the process.

“Therefore, the bidding process for accreditation in this municipality followed all the necessary steps as established by Law No. 14,133/2021, which governs the general rules for bidding and contracting in the Public Administration”, said in the official statement.

“Bodó City Hall is hereby clarifying information regarding the accreditation of companies to operate lottery services in the municipality. In a first analysis, it is important to point out that the constitution and implementation of the Lottery of the Municipality of Bodó – LOTSERIDÓ, went through a process that followed all the principles necessary for the proper functioning of Public Administration.

In this way, the process began with the approval of the bill in the Chamber of Councillors, with COMPLEMENTARY LAW Nº 01/2024, OF JULY 3, 2024, being sanctioned, which was published in the Official Gazette of the Municipalities of Rio Grande do Norte (FEMURN), on the date of July 4, 2024, finally creating the public service of the Lottery of the Municipality of Bodó – LOTSERIDÓ, and their respective competencies.

After the legislative process, the Executive branch promulgated through DECREE No. 11/2024 OF SEPTEMBER 12, 2024, published in the Official Gazette of the Municipalities of Rio Grande do Norte (FEMURN), on September 13, 2024, the regulations of the Lottery of the Municipality of Bodó – LOTSERIDÓ, making it an act capable of taking effect.

Therefore, the bidding process for accreditation in this municipality followed all the necessary steps as established by Law No. 14,133/2021, which governs the general rules for bidding and contracting in the Public Administration.

Thus, the Official Gazette of the Municipalities of Rio Grande do Norte (FEMURN) was published on October 14, 2024, the notice of Electronic Accreditation Tender No. 1/2024, Administrative Process 1,966/2024, whose purpose is ACCREDITATION FOR HIRING QUALIFIED LEGAL PERSONS TO EXPLORATE THE MODALITIES PASSIVE AND PROGNOSIS LOTTERIES, IN VIRTUAL MEDIA, therefore starting to receive the necessary documentation on October 17, 2024, ending the receipt procedure on December 30, 2024.

It is important to point out that throughout the bidding process, there were no questions or objections against the notice and its annexes, as well as letters were issued to the Secretariat of Prizes and Bets – SPA, informing all the companies and their respective brands that had been accredited until that moment.

In this context, observing the sieve of constitutionality, it is inherent to infer that the possibility of creating municipal lotteries is a matter that is supported by the construction of the federative model that guarantees the non-existence of hierarchy between the Union, States and Municipalities, a model that must be preserved and supported in the face of the various attempts to delegitimize it.

Thus, once protected by the Magna Carta, municipal administrative competence enabled our municipality to establish the process of creating and implementing lotteries, which culminated in a movement that today encompasses several municipalities such as: São Paulo, Belém, Porto Alegre, Cuiabá, Belo Horizonte, São José dos Campos, Campinas, Guarulhos, São Vicente, Goiânia, Gramado, Itaquaquecetuba, Agudos, Cabo Frio, Cabo Santo Agostinho, Sorocaba, Pelotas, Aracaju, Juiz de Fora, Caxias do Sul, Anápolis, Maceió, Águas Lindas de Goiás, among other municipalities.

Furthermore, Bodó City Hall highlights its mission to bring new revenue to the municipality, without the need to create new taxes, with the aim of providing investments that will be vital for building a greater quality of life for our citizens. It is also important to highlight that, for every R$ 1.00 (one real) collected by the municipality, the Union will raise more than R$ 5.00 (five reais), making it an indispensable collection for the Brazilian State.

We emphasize that Bodó City Council has been acting in the supervision of already licensed operations, in order to prevent any practices that do not comply with the requirements contained in current legislation, especially regarding compliance with the criteria that permeate responsible and legal gambling.

Finally, given the above, it is undeniable to infer that the entire procedure was guided by the concern to ensure respect for current norms and the principles of federalism and public administration, essential for legal security and public interest.
