The Prizes and Bets Secretariat of the Ministry of Treasury – SPA-MF published this Friday (6), Ordinance SPA/MF No. 1,902/05.12.2024. This document deals with the immediate implementation of advertising standards in Ordinance SPA/MF 1.231/31.07.2024, which defines guidelines for responsible gaming, in addition to regulating marketing, communication, advertising and advertising actions for the betting sector.
The ordinance also establishes the rights and duties of both bettors and sports betting and online gaming operators.
Signed by the Secretary of Prizes and Bets of the Ministry ofTreasury, Regis Dudena, the regulation was launched in compliance with the preliminary decision in the Direct Actions of Unconstitutionality (ADI 7721 and ADI 7723), handed down by minister Luiz Fux and unanimously confirmed by the other ministers of the Supreme Court. Federal Court.
This measure, published in the Official Gazette of the Union (DOU), requires the immediate application of precautionary measures that impose important restrictions on betting advertising in the national territory.

“SPA/MF ORDINANCE No. 1,902, OF DECEMBER 5, 2024
Provides for the immediate application of rules provided for in Ordinance SPA/MF No. 1,231, of July 31, 2024.
THE SECRETARY OF PRIZES AND BETS OF THE MINISTRY OF TREASURY, in the use of the powers conferred on him by art. 55, item I, of Annex I of Decree No. 11,907, of January 30, 2024, in compliance with the preliminary decision issued in Direct Unconstitutionality Actions No. 7721 and No. 7723 and in view of the provisions of Law No. 13,756, of 12 January December 2018, and in Law No. 14,790, of 29 December 2023, resolves:
Art. 1 This Ordinance provides for the immediate application of items XVI, XVII, XVIII and XIX of the caput of art. 12, of item I of the caput of art. 13 and item II of the caput of 17 of SPA/MF Ordinance No. 1,231, of July 31, 2024.
Art. 2 SPA/MF Ordinance No. 1,231, of July 31, 2024, comes into force with the following wording:
“Art. 59. Items XVI, XVII, XVIII and XIX of the caput of art. 12, item I of the caput of art. 13 and item II of the caput of art. 17 of SPA/MF Ordinance No. 1,231, of 31 July 2024, has immediate application.
Single paragraph. The inspection, monitoring and sanction rules for non-compliance with the provisions indicated in the caput, including those provided for in arts. 19, 21 and 22, will be implemented by the Prizes and Betting Secretariat immediately.
Art. 59-A. The inspection, monitoring and sanctioning rules for non-compliance with the other provisions set out in this Ordinance will be implemented by the Prizes and Betting Secretariat from January 1, 2025.” (NR)
