The Federal Supreme Court (STF) will discuss the legality of online betting in public hearings this Monday and Tuesday (11 and 12 November). Minister Luiz Fux will lead the debate on the Direct Action of Unconstitutionality, proposed by the National Confederation of Commerce and the Solidariedade party, which question the constitutionality of the Bets Law (Law 14,790/2023).

Complex issues being debated in the STF

More than 40 participants will discuss the impact of the new legislation. The event will feature government representatives, financial institutions and betting experts. Among the notable figures confirmed are:

  • Régis Dudena, Secretary of Prizes and Bets at the Ministry of Finance.
  • Macaé Evaristo, Minister of Human Rights.
  • Bruno Dantas, president of the Federal Audit Court (TCU).

Furthermore, associations linked to the betting sector will be present, such as:

  • The Legal Gaming Institute (IJL)
  • The National Association of Games and Lotteries (ANJL)
  • The International Gaming Association (AIGAMING)
  • The Brazilian Psychiatric Association (ABP)
  • The Brazilian Institute for Consumer Protection (Idec)

Minister Luiz Fux believes that public hearings are a crucial opportunity to understand the effects of online betting. Discussions are expected to address a variety of issues, including:

  • Neurological effects. The problem of gaming addiction.
  • Economic consequences. How the betting market impacts the Brazilian economy.
  • Criminal and tax implications. The need for regulation and control in the sector

Thus, after the hearings, Fux committed to preparing his vote on the issue and taking the case directly to judgment in the Court’s plenary. This decision could have significant consequences, especially since there will be no prior granting of an injunction.

But the government, in turn, is already preparing to regulate the betting market. The Ministry of Finance published a set of 11 ordinances that seek to:

  • Regulate the monitoring of bets by CPF.
  • Limit the payment methods available on platforms.
  • Regulate the advertising of companies in the sector.

Furthermore, a ban on the use of credit cards for transactions on betting platforms is under discussion.

Expectations for online betting in Brazil

In other words, public hearings are essential for clarifying the multiple dimensions related to online betting in Brazil. Thus, with the presence of experts and government representatives, the debate is expected to bring to light the social and economic impacts of “bets”.

The outcome of these discussions could influence future regulation of the sector and protect consumers, especially the most vulnerable. Therefore, the deliberations promise to shape the future of online betting in Brazil and establish a new regulatory framework in this growing market.
