The vote on bill 2,234/2022, which authorizes the operation of casinos and bingos, legalizes gambling and allows betting on horse races, was once again postponed in the Senate‘s Constitution and Justice Committee (CCJ).
The text, approved at the beginning of 2022 in the Chamber of Deputies, divides opinions in the Senate. This is because the proposal faces resistance from the evangelical bench and conservative groups.
Therefore, a collective review request was granted. The president of the CCJ, Davi Alcolumbre responded to the request: “As agreed with the members of the commission, this presidency grants a collective view following the regulatory terms”.
The report was presented by Senator Irajá (PSD-TO) on April 24th and went through a public hearing on May 9th. The following week, senator Eduardo Girão recorded a separate vote against the project.
However, there is an environment for voting to take place until the recess, in July, with a chance of being approved.
Understand the bill
The text provides for the creation of the National Gaming and Betting System (Sinaj) composed of the Ministry of Finance, gaming and betting operating entities and companies related to the business, such as in the accounting area, machine rental companies. And it allows the creation of a regulatory agency that will also be part of Sinaj.
Furthermore, the project establishes the charge of CIDE-Jogos, whose rate will be up to 17% on the gross revenue from gaming exploitation. Of the amount, 34% will go to the State Participation Fund (FPE) and the Municipal Participation Fund (FPM), 16% for each.
While another 12% will be transferred to the Brazilian Agency for International Tourism Promotion (Embratur) and the remainder divided into different funds.
Casinos
The bill also allows the installation of casinos in hotel complexes with at least 100 high-standard rooms and that have the capacity to hold cultural events, which can occupy up to 20% of the site’s area.
The proposal envisages the installation of a casino for states with up to 15 million inhabitants. Two casinos for those with between 15 million and 25 million and three for those with more than 25 million people.
