Sports betting PM: parliamentarians suggest amendments to change text

The period for forwarding amendments to the sports betting PM has ended. The measure was published last Tuesday, in the Official Gazette.

Now, parliamentarians will have four months to assess the measure and the norms presented to add or remove points from the text sent by the Federal Government.

In all, 196 amendments to the sports betting PM were presented. They will be analyzed by a joint commission.

In one of his amendments, Senator Angelo Coronel wants to make explicit in the definition of a gambler that he can only be of legal age.

In addition, the senator aims to create a register of people with pathological gambling disorder.

“Gambling addiction is a concern for those who are against it, but the experience in other places is that you can identify the addict. With information from the betting platforms, it is possible to register people who exhibit pathological behavior”, said Coronel about his amendment.

The parliamentarian also presented a rule to prohibit advertising for betting sites that do not have authorization, as well as two other items that reopen the discussion on the jogo do bicho and casinos in resorts.

Provisional measure 1,186/2023 also excluded the Union’s exclusivity in this lottery modality, defining that the fixed quota bet is in the form of a public service.

This lottery “will be operated exclusively in a competitive environment, with no limit on the number of grants, with the possibility of commercialization in any commercial distribution channels, physical and virtual, subject to the regulations of the Ministry of Finance”.

Removing the ban on people included in credit protection records

Deputy Bacelar (PV-BA) proposes to amend the measure’s article to remove the ban on participation in games and betting by people who are registered in national credit protection registers, such as SPC and Serasa.

“If it’s already complicated to be on the credit restrictive list because of a debt, imagine being included in it without owing anything to anyone. The National Database of the Judiciary (DataJud), created by the National Council of Justice (CNJ), shows that from January to May of this year, 250,869 cases of undue inclusion in the register of defaulters were judged”.

“And yet, there are over 751,000 lawsuits pending in court. If after five years the CPF remains negative, if it is included in the restrictive list without having any debt or if it is prevented from placing sports bets, the consumer can look for a lawyer he trusts”, justified the deputy of the PV of Bahia.

Taxation proposed by the PM of sports betting can be changed

The deputy also mentioned the taxation of gamblers. “It is essential to adopt balanced and healthy taxation for market players”.

International studies point out that a global taxation of betting activity between 15% and 20% on Gross Gaming Revenue (GGR) is considered ideal to promote the adherence of bettors to the regulated market and, consequently, increase direct tax collection and reduce the performance of the unregulated market”.

“In this context, for taxation to align with the best practices observed in the market, it is important to reduce the income tax rate applicable to bettors to 15%, this is a strategic measure to encourage adherence to the regulated market.

By establishing fair taxation, in which the system of collection for capital gains already adopted in several sectors in the country applies, we can mitigate the risks of bettors seeking alternatives in the illegal market, where operating margins are usually more attractive”, explains Bacelar.

Prohibition of bets that depend on the actions of athletes

Another amendment to the sports betting PM suggests a ban on bets that depend on the actions of athletes, such as penalties, cards, corners, among others. The amendment was presented by deputy Paulo Azi.

“The prohibition of placing sports bets that depend on the actions of an individual player, including, but not limited to, penalty kicks, fouls near the penalty area, corner kicks, laterals, yellow cards and red cards, aims to prevent unsportsmanlike behaviour. and possible manipulations and negative influences during the games”, says the deputy.
