PM for sports betting: check out what is valid from today

This Tuesday, the 25th, the Federal Government published the PM for sports betting, a provisional measure that regulates the sector.

According to the new measure, bookmakers will be taxed at 18%, and Income Tax will be charged on bets won above the exemption range (R$ 2,112 in 2023).

Therefore, the bookmakers will be able to keep the 82% of the resources that remain.

Understand the changes that come into force with the sports betting MP:

Impostos

Taxes collected from sports betting sites will be divided as follows:

10% for social security, 0.82% for basic education, 2.55% for the National Public Security Fund, 1.63% for clubs and athletes and 3% for the Ministry of Sports.

While the prize is awarded, the bettor will be taxed at 30% of the Income Tax. However, all prizes up to R$ 2,112.00 will be exempt.

The norms come into effect this Tuesday, however, they need to be considered by the National Congress within four months so as not to lose their value.

With the regulation of betting, the Federal Government projects to collect about R$ 3 billion per year.

After the recess of Congress, the intention is that the MP for sports betting becomes a Bill.

Last week, the new Secretariat for Betting and Lotteries at the Ministry of Finance was announced with the creation of specific positions.

Advantages of sports betting PM

Expected since December 2018, the regulation of sports betting tends to increase revenue, generate new jobs and encourage responsible gambling by companies in the sector.

In addition, the sports betting MP will help curb attempts to manipulate results in sporting events.

Partners or shareholders of bookmakers cannot be related to sports entities or competitions. And, companies must notify the Ministry of Finance promptly of any tournament suspected of manipulation.

Groups that intend to operate in Brazil will need to be duly registered in the country. After the approval of the Bill, the houses will have 180 days to finalize the licensing.

As already happens with traditional lottery prizes in Brazil, prizes for bets not redeemed by winners within three months will be forwarded to Fies (Student Financing) by July 2028.

Subsequently, the forgotten prizes will go to the National Treasury.

Who can’t bet?

According to the sports betting PM, minors under 18, people with access to lottery systems, registered in national credit protection registers and public agents who act with tax inspection and Brazilians susceptible to gambling addiction are prohibited from betting.

In addition, coaches, referees and sportsmen who may have an impact on the results of competitions and games will also not be able to bet.
